Notes for Charles Kilgore

There has been many people thought that Martha was a McIlhaney. Here is proof that she WAS NOT a McIlhaney.

The only information of this is that it was copied from Virginia Soldiers of 1776.
Loudoun Co. court 14 aPL, 1834. ON THE MOTION OF COUNSEL IN BEHALF OF THOSE CONCERNED, THE FOLLOWING EVIDENCE WAS ENTERED OF RECORD. THAT JAMES McIlhaney, dec'd. of Loudoun County died intestate. That he left as his lawful children and Heirs:
1, Rosannah married to Lewis Elbzey
2. Nancy married to John White
3. John
4. Elizabeth, married George M. Frye
5. Cecelia married to Francis Stribling
6. James
7. LOUISA MARRIED TO CHARLES J. KILGORE
8. Mortimore
Of these the following have died:
1. Rosannah Elbzsey, leaving as her lawful children:

2. Rosannah, an infant under 21 years of age

The court is satisfied that the above are the only lawful heirs of James McIlhaney, dec'd. and that Taliaferro M.McIlhaney is the Guardian of the infants Francis Elbzey, and Mortimer McIlhaney is guardian of the infants Francis J. , Erasmus M., and Cecilia M. Stribling., and that the heirs of LOUISA KILGORE reside with their father in Maryland. Copy teste, C. Binns, Clerk.

White and Mary E., his wife appointed the same atty. 10 May 1834. Wm. Clendenning, J. of P. ALEXANDER KILGORE and Margaret his wife of Montgomery County, MD., appoint James McIlhaney their Atty.

Before Thomas F.W.Vinson, J. of. P. 11 Apl. 1834. Attest, Brice Selby, IV.George M. Frye and Mary his wife of Highland County, Ohio, appoint same ATTY.. WITNESS Daniel Miller and William Scott. 4 Apl. 1834. CHARLES KILGORE ,father and guardian of James M. and John M. KILGORE, heirs of LOUISA KILGORE who was a daughter of Capt. James McIlhaney appoint the same Atty. Acknowledged before Samuel Stonesbed (?) and Henry Harding, Justices Montgomery Co. Md.

Mortimer McIlhaney of Loudoun Co. Va. in his own right and as a guardian to
Francis J., Erasmus M. and Cecilia M. Stribling appoint the same atty.

Taliaferro McIlhaney of Loudoun Co. in his own right and guardian of Rosanna
Elbzey appointed same atty. 10 May 1834.

Recieved of Register of Land Off.. Warrant 7770 for 4000 acres, issued 24 May,
1834 to James McIlhaney, Atty. Recorded Book 3, page 345.

Will of Charles Kilgore:

In the name of God Amen. I, Charles Kilgore of the County of Greene and State of Tennessee being infirm in body but of perfect mind and memory Thanks be to God, calling into mind the Mortallity of my body and knowing that it is appointed unto all men once to die do make ordane and ordane and declare this instrument my last will and Testament revoking all others.

It is my will that all my just debts be putaly and speedely paid and the remainder of my estate I despose of in the following maner----

Item 1st I give and bequeath unto my well beloved wife Martha Kilgore two Negro girls Phillis and Sara, one Hoss and Sadle two milch cows and all my house hold and kitchen furniture of every discreption during her natural life and it is my will that she remain in possession of all my real and personal estate during her widow hood but if she should marry my Executors is required to proceed immediately to dispose of that part not left to her during her life in the manner herein after directed; and whereas the above named Negro girl Philes now in the possession of Joseph Wacker and unreasonable with held from me by him. The said Joseph my son William Kilgore is requested after my decease to use all lawful means in his power to recover said Negroes and if he sould succeed in recovering them from the said Wacker they are to remain in possession of my wife Martha Kilgore during her natural life and at her death I give and bequeath the said Negroes to him the said William Kilgore and his heirs forever.

Item 2nd I give and bequeath my daughter Mary Culberson one Negro girl called Delilah and her heirs forever.

Item 3rd I give and bequeath to my daughter Rebecca Sherel two Negro girls Hester and Sibela with all their increase to her and her heirs forever.

Item 4th I give and bequeath to my daughter Martha Walker two Negro girls Pug & Kate with all their increase to her and her heirs forever.

Item 5th I give and bequeath to my son William Kilgore my Negro woman Nance and her increase to him and his heirs forever.

Item 6th I give and bequeath to my son John Kilgore at the decease of my wife Martha Kilgore my Negro boy Elisha to him and his heirs forever.

Item 7th I give and bequeath unto my daughter Sara Smith Henderson one Negro boy called Allen which she has alredy received to her and her heirs forever.

Item 8th I give and bequeath to my son-in-law Joseph Walker one Negro boy called George which he has already received to him and his heirs forever.

Item 9th I give and bequeath unto my son James Kilgore one Negro boy Jery together with the plantation whereon I now live which he is to receive at the decease of my wife Martha Kilgore to him and his heirs forever.

Item 10th It is my will that all my Estate which may remain at the decease of my wife Martha Kilgore be sold and the monies arising from said sale after paying Wiliam Kilgore and John M. Kilgore one hundred and fifty dollars each to be equally divided betwen by three sons William Kilgore John M. Kilgore and James Kilgore and it is my will that if any Negroes be sold that some of my own connection purchase them.

Item 11th It is my will that my old Negro woman Delilah for her long and faithful service receive her freedom immediately after my decease and that my Mulato girl Rachel receiver her freedom at the age of twenty years and my Negro girl Peg receive her freedom at the age of twenty-five.

And lastly. I do hereby constitute and appoint my son John M. Kilgore and John Gregg my Executors to execute this my last will and Testament in witness whereof I have here unto set my hand and seal the 6th day of June, 1822.

Line Records corrected June 27, 1806 Application for a new certificate: State of Tennessee County of Greene ss. On this 17th day of May 1820; before me, the subscriber, a Justice of the Peace for the said county of Greene personally appeared Charles Kilgore who, on his oath, declares that he is the same person formerly belonged to the company commanded by Captain James Dysart in the regiment commanded by Colonel William Campbell in the service of the United States; that his name was placed on the pension roll of the state of Tennessee that he never received a certificate of that fact, from the Secretary of War; and he now wishes to obtain one. Sworn and subscribed to, before me, the day and year aforesaid

Sir a Charles Kilgore of this county he has been on the Pension list of the United States as a pensioner and has generally drawn his Pension at Washington City but was informed he was to be paid at Knoxville lately made application there but his name cannot be found will you be so good as direct (?) his name to be reported (?) if to be paid there.
